The Bank of Nova Scotia (Scotiabank) has established the Scotiabank Merchant Partner Program (the Program) in partnership with local merchants and businesses (the Merchants) you visit everyday, to demonstrate its commitment to our loyal customers.
The Program allows you to instantly benefit from discounts, rebates and promotional offers on your purchases.
It is free. It is instant. All you have to do is use your Scotiabank credit card at the time of purchase.
TERMS AND CONDITIONS
All you need to do is use your Scotiabank card when you pay for goods and services at a participating Merchant.
By using your Scotiabank credit card, you acknowledge that you have read, understood and undertake to abide by all these Terms and Conditions:
- You must be the legal holder of a credit card issued in your name by Scotiabank;
- The Merchants retain the right to request independent identification from you;
- Your account must be in good standing and not overdrawn or in arrears;
- Your credit card must be in good standing and not reported lost, misplaced, stolen, tampered, frozen, delinquent, written-off, overdrawn or fraudulently obtained;
- The Program is made available to you for your personal, non-commercial use only. In that respect, the Merchants may impose a limit on items purchased;
- The discounts, rebates or promotional offers may not accumulate with other discount, rebate, or promotional offer made available by Scotiabank or the Merchants. Only one rebate, discount or offer per card per purchase. The rebate, discount or offer may not be divided between different cards or cardholders;
- For discount and offers on hotel rooms, the payment must be made in full and must be agreed at the time of reservation. Non room charges such as room service, spa, telephone calls, television, laundry, tours, mini bar, parking, gratuities and other accessory purchases and expenses; are not included in the offer;
- The Merchants retain the right to identify eligible purchases or exclude certain items from the Program. We recommend that you enquire about the discounts, rebates or promotional offers available at the time of or before completing the transaction with the Merchants;
- Participating Merchants and their establishments as well as eligible products and services may vary from time to time, without prior notice;
- The quality and merchantability of the product and services, transaction of purchase and sale, lease, hire, delivery, product warranties, return of merchandise, refunds, credits and generally all aspects of the transaction made between you and the Merchants, remain the responsibility of the Merchants. Scotiabank will not be responsible or liable for any part of the transaction and the underlying products or services;
- Scotiabank reserves the right at any time and without notice, to modify or discontinue, temporarily or permanently, the Program in whole or part. You agree that Scotiabank will not be liable to you or to any third party for any modification or discontinuation of the Program;
- Scotiabank makes no representation or warranty on the service level, quality and suitability of products and services offered by the Merchants. In addition, Scotiabank does not necessarily endorse the Merchants nor their products or services;
- Scotiabank represents that there is no joint venture, agency or partnership between the Merchants and Scotiabank and the parties are independent entities;
- Scotiabank shall not be liable for any damages, direct or indirect, consequential, incidental, damages for loss of profit, business opportunity or opportunity cost, related to the performance or non performance of the Merchants, products or services, whether such damages may have or not been foreseen, even where Scotiabank may have been advised of the possibility of such loss or damages;
- The Program is made available to you by Scotiabank free of charge;
- These Terms and Conditions are governed by the laws of Jamaica.
These Terms and Conditions are in addition to and not in substitution for the Terms and Conditions applicable to your Cardholder Agreement and Personal Financial Services Agreement (PFSA). In case of conflict, the Terms and Conditions provided under your Cardholder Agreement and PFSA supersede the Program’s Terms and Conditions.
